1. About Sell & Tow
Sell & Tow ("we," "us," or "our") operates as a marketplace platform connecting customers who need transport services for RVs, tiny homes, and sheds with independent service providers. We are NOT a transport company and do NOT directly provide transport services.
2. Platform Services
2.1 What We Provide
- Online marketplace platform for connecting customers and service providers
- Tools for service providers to manage their profiles and subscriptions
- Payment processing for provider subscription fees only
- Administrative tools and support
2.2 What We Don't Provide
- Direct transport or moving services
- Insurance for transported items
- Guarantees regarding service provider performance
- Payment processing for customer-to-provider transactions
3. User Accounts
3.1 Account Creation
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Types
- Customers: Can browse listings and submit service requests at no cost
- Service Providers: Must subscribe to list services and receive leads
4. Service Provider Subscriptions
4.1 Subscription Tiers
- Free: $0/month - Basic listing
- Featured: $49/month - Enhanced visibility and verification badge
- Pro: $149/month - Priority placement and advanced features
- Premium: $299/month - Maximum visibility and dedicated support
4.2 Payment Terms
Subscription fees are charged monthly in advance. All payments are processed securely through Stripe. Fees are non-refundable except as required by law.
4.3 Cancellation
You may cancel your subscription at any time. Access will continue through the end of the current billing period. No refunds will be provided for partial months.
5. Service Provider Responsibilities
Service providers agree to:
- Maintain proper licensing, insurance, and permits as required by law
- Provide accurate information about services, pricing, and availability
- Respond promptly to customer inquiries
- Perform services professionally and safely
- Comply with all applicable laws and regulations
6. Customer Responsibilities
Customers agree to:
- Provide accurate information in service requests
- Communicate honestly with service providers
- Make payment arrangements directly with chosen providers
- Follow safety guidelines during transport preparation
7. Independent Contractor Relationship
IMPORTANT: Service providers are independent contractors, NOT employees or agents of Sell & Tow. We do not:
- Control how providers perform their services
- Set provider pricing (providers set their own rates)
- Provide equipment, vehicles, or supplies
- Supervise or direct provider activities
- Handle customer payments for transport services
8. Limitation of Liability
WE ARE NOT LIABLE FOR:
- Damage to RVs, tiny homes, sheds, or other property during transport
- Personal injury or death resulting from transport services
- Actions or omissions of service providers
- Disputes between customers and providers
- Quality, safety, or legality of services provided
- Financial losses from provider non-performance
Customers and providers interact at their own risk. We strongly recommend:
- Verifying provider credentials and insurance
- Obtaining written contracts and estimates
- Documenting item condition before transport
- Purchasing appropriate insurance coverage
9. Disputes
Disputes between customers and providers must be resolved directly between the parties. We may provide contact information but are not responsible for mediating or resolving disputes.
10. Intellectual Property
All content on sellandtow.com, including text, graphics, logos, and software, is owned by Sell & Tow or licensed to us and protected by copyright and trademark laws.
11. Prohibited Activities
Users may not:
- Post false, misleading, or fraudulent information
- Harass, threaten, or abuse other users
- Violate any laws or regulations
- Attempt to circumvent platform fees or payments
- Scrape, copy, or misuse platform data
- Impersonate others or create fake accounts
12. Termination
We reserve the right to suspend or terminate accounts that violate these terms or engage in prohibited activities, with or without notice.
13. Changes to Terms
We may update these Terms of Service at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
14. Governing Law
These terms are governed by the laws of the State of North Carolina, USA. Any disputes shall be resolved in the courts of North Carolina.
